These Terms of Service (the "Terms") govern your use of the 19Fairways mobile and web applications and related services (the "Service"), operated by 19Fairways LLC ("19Fairways," "we," "us," or "our"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Your account
You need an account to use most of the Service. You sign in through a third-party identity provider (Apple, Google, or Microsoft); you are responsible for the security of that provider account and for all activity under your 19Fairways account. You must be at least 13 years old (or the minimum age required in your region) to use the Service.
You can delete your account at any time from the app's settings. Deletion removes your profile and personal data as described in our Privacy Policy. If you have an active paid subscription, cancel it first — deleting your account does not automatically cancel a subscription billed through the App Store, Google Play, or Stripe (see §4).
2. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or to harass, spam, or impersonate others;
- Attempt to access another user's account or data, probe or circumvent security measures, or interfere with the operation of the Service;
- Scrape, resell, or redistribute the Service or its data, or use automated tools to send invitations or create accounts;
- Reverse engineer the Service except where that right cannot be excluded by law.
3. Subscriptions & billing (19Fairways Pro)
Parts of the Service are offered as a paid subscription ("Pro"). Pricing and included features are shown at the point of purchase.
- Auto-renewal. Pro subscriptions renew automatically (monthly or annually, as selected) until canceled. Your payment method is charged at the start of each billing period.
- Where you're billed. Purchases made in the iOS app are billed by Apple through your App Store account; purchases in the Android app are billed by Google Play; purchases on the web are billed by Stripe on our behalf. The store that took your payment is the one that processes renewals, cancellation, and any refund.
- One entitlement. Pro is attached to your 19Fairways account, not your device. A subscription purchased on any platform applies everywhere you sign in. Maintain only one active subscription; we are not responsible for duplicate subscriptions purchased on multiple platforms.
- Price changes. If prices change, we will give notice as required by the applicable store, and changes apply at your next renewal.
- Free features. Features outside Pro remain free. We may adjust which features are free vs. Pro over time; active subscribers keep what they paid for through the end of their paid period.
4. Cancellation & refunds
- Cancel anytime. Cancellation stops the next renewal; you keep Pro until the end of the current paid period. iOS: Settings → Apple ID → Subscriptions. Android: Play Store → Payments & subscriptions. Web: the "Manage subscription" link in the app opens your Stripe billing portal.
- Refunds. Purchases through Apple or Google are subject to that store's refund policy and are issued by the store, not by us. For web (Stripe) purchases, contact support@19fairways.com; refunds are at our reasonable discretion except where required by law.
- Account deletion does not cancel a subscription. Cancel with the store that bills you before deleting your account.
5. Your content
You retain ownership of the content you submit (names, scores, events, comments, photos). You grant us a worldwide, non-exclusive license to host, store, display, and share that content as needed to operate the Service — for example, showing your scores on a shared leaderboard to the players in your round or event. You are responsible for having the right to share what you submit.
6. Scores, handicaps & wagers
- Handicap calculations in the Service follow the World Handicap System differential formula but are not an official USGA/WHS handicap index and are not endorsed by the USGA.
- GPS distances are estimates and depend on device hardware, signal, and course data quality. Always verify on the course.
- The side-bet and "Money" features are scorekeeping tools only. 19Fairways does not process, hold, or transfer wagered funds, is not a party to any wager, and does not facilitate gambling. You are solely responsible for compliance with the laws that apply to any private wagers in your jurisdiction.
- Tournament entry fees. When a host enables online entry-fee collection, registrants pay by card through Stripe Connect, and the funds settle directly to the host's connected Stripe account — 19Fairways never holds them. Processing fees apply: Stripe charges 2.9% + $0.30 per transaction and 19Fairways charges a 2.5% platform fee. Depending on the host's setting, either the host absorbs these fees (the player pays exactly the entry fee) or they are added to the player's total at checkout (the host receives the full entry fee); the exact amount is always shown before payment. Refunds for entry fees are handled by the host through Stripe. Stripe's fees are set by Stripe and may change.
7. Our property
The Service, including its software, design, logos, and content we provide, is owned by 19Fairways LLC or its licensors and protected by intellectual-property laws. We grant you a personal, non-transferable, revocable license to use the apps for their intended purpose. Course data is provided by third-party sources and may not be redistributed.
8. Disclaimers
The Service is provided "as is" and "as available." To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-interruption. We do not warrant that scores, distances, handicaps, or payout calculations are error-free. Golf is played outdoors: never rely on the app in a way that affects your safety.
9. Limitation of liability
To the fullest extent permitted by law, 19Fairways LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost profits or data, arising from your use of the Service. Our total liability for any claim is limited to the greater of (a) the amount you paid us in the 12 months before the claim or (b) US $50. Some jurisdictions do not allow these limits, so they may not fully apply to you.
10. Termination
We may suspend or terminate your access if you materially violate these Terms (including the acceptable-use rules in §2) or if required by law. Where practicable we will notify you first. On termination for cause, no refund is due for the remainder of a billing period except where required by law or the applicable store's policy.
11. Changes to these Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above and, for material changes, provide additional notice in the app. Your continued use of the Service after changes take effect constitutes acceptance.
12. General
Entire agreement
These Terms and the Privacy Policy are the entire agreement between you and 19Fairways LLC regarding the Service and supersede any prior agreements on the subject.
Severability & waiver
If any provision of these Terms is held unenforceable, the remaining provisions stay in full effect. Our failure to enforce any right or provision is not a waiver of it.
Assignment
You may not assign or transfer these Terms without our prior written consent. We may assign them, including to an affiliate or in connection with a merger, acquisition, or sale of assets.
Governing law & venue
These Terms are governed by the laws of the State of Indiana, without regard to its conflict-of-laws rules. To the extent a dispute is not otherwise resolved, the exclusive venue is the state and federal courts located in Indiana, and you consent to their personal jurisdiction.
Force majeure
We are not liable for any failure or delay caused by events beyond our reasonable control, including outages of third-party services, networks, or app stores.
Apple App Store & Google Play
If you obtained the app from the Apple App Store or Google Play, you acknowledge that these Terms are between you and 19Fairways LLC only, and not with Apple Inc. or Google LLC. The applicable app-store provider has no obligation to furnish any maintenance or support for the Service, and is not responsible for addressing any claims relating to the app. Apple and Google, and their subsidiaries, are third-party beneficiaries of these Terms and may enforce them against you. You represent that you are not located in a country subject to a U.S. Government embargo, are not on any U.S. Government restricted-parties list, and will comply with the applicable app-store terms of service.
